1. Nature of Service
Blue Mastil Cancún operates exclusively as an intermediary in vessel rentals. We are not owners, operators, or directly responsible for the vessels offered on this site. Our service consists solely of facilitating the connection between the client and the vessel owners or operators.
2. Limitation of Liability
Blue Mastil Cancún is not responsible for personal injury, property damage, losses, accidents, injuries, illness, or any other harm that may occur before, during, or after the use of the vessels. The client accepts that navigation and water activities carry inherent risks and assumes full responsibility for their participation. Responsibility for the condition, maintenance, safety, and operation of the vessels rests exclusively with their owners and/or operators.
3. Client Responsibility
The client is responsible for their own safety and that of their guests during the use of the vessel. The client agrees to follow crew instructions, respect maritime safety regulations, and not engage in activities that endanger their integrity or that of others. Use of the vessel under the influence of alcohol or prohibited substances is the sole responsibility of the client.
4. Reservations and Payments
Reservations are subject to availability. Prices, schedules, and specific conditions for each vessel are agreed directly between the client and the vessel operator. Blue Mastil Cancún does not guarantee the availability of any particular vessel nor the published prices, which may change without prior notice.
5. Cancellations
Cancellation policies depend on each vessel operator and will be communicated at the time of booking. Blue Mastil Cancún is not responsible for refunds or penalties arising from cancellations.
6. Weather Conditions
Departures are subject to favorable weather and sea conditions. In case of bad weather, the departure may be rescheduled or cancelled for safety reasons. This decision is made by the captain or vessel operator and does not create any obligation for refund by Blue Mastil Cancún.
7. Website Use
The content of this website (texts, images, videos, logos) is the property of Blue Mastil Cancún or used with authorization. Its reproduction, distribution, or commercial use without prior written authorization is prohibited. Vessel images are for reference purposes and may not reflect the exact current condition of the vessel.
8. Indemnification
The client agrees to indemnify and hold harmless Blue Mastil Cancún, its partners, employees, and collaborators against any claim, demand, damage, or expense (including legal fees) arising from the use of the vessels or from breach of these terms.
9. Applicable Law
These terms and conditions are governed by the laws in force in Mexico. Any dispute arising from the use of this site or the services offered shall be submitted to the jurisdiction of the competent courts in Cancún, Quintana Roo, Mexico.
10. Acceptance of Terms
By using this website and/or contracting our intermediary services, the client fully accepts these terms and conditions. If you do not agree with any of these terms, we ask that you do not use our services.
